If that's the case changing the file shouldn't be bannable, but if their only method of seeing if you're eligible for $40 of dlc is a single toggle in a plaintext file they have some serious problems. The Season Pass file displays the confirmation dialog ingame but unless they're really, unbelievably stupid Gearbox will check to see if the pass has been bought by your steam account before pushing the dlc to you.
